Welcome to Emerald Goddess Gardens®. These Terms of Sale govern your use of our website and the fulfillment of your orders. By placing an order with us, you agree to these terms. Please review them carefully, and contact us with any questions or concerns prior to completing your purchase.
Cancellations
Orders may be canceled up to the day prior to their scheduled shipment. We are unable to accommodate requests to cancel after orders have begun processing.
Order Changes
Our payment processor policies prohibit manual changes to orders once payment has been processed. Therefore, we cannot add or delete items, make substitutions, or change shipping addresses.
Refunds & General Warranties
It is our goal to always meet or exceed expectations regarding your purchase. Please note we consider all sales as final when plants are unpackaged and accepted into the care of the buyer. Except as expressly provided in our Limited Conditional Warranty, Emerald Goddess Gardens® makes no other warranties, express or implied, regarding the plants or any products sold, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
Agricultural & Local Restrictions
Due to agricultural regulations, not all plants can be shipped to all states. While we note known restrictions in our product listings, individual states frequently update their regulations. Furthermore, restrictions may exist at the local county, municipal, homeowners' association (HOA), or specific "Areas of Special Concern" that we may not be aware of. Therefore, it is the buyer's responsibility to determine whether a plant is appropriate and legally permitted for their specific location and intended application.
Limitation of Liability
In no event shall Emerald Goddess Gardens® be liable for any indirect, incidental, special, punitive, or consequential damages arising from your purchase or use of any product, or any other claim related in any way to your purchase or use of the product, including but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Our liability for any product purchased is strictly limited to the purchase price of that product.
