Warranty and Returns Policy


Emerald Goddess Gardens® Limited Conditional Warranty

Plants purchased from Emerald Goddess Gardens® are guaranteed to arrive alive and in good, healthy, viable condition. In the unlikely event your order is lost or sustains severe damage in transit, we will either replace or refund your plant (at our option), provided prompt and proper notice and photo validation are submitted as required to support claims with the carrier.


Understanding Minor Cosmetic Imperfections:

While we meticulously package your plants, minor cosmetic damage can occasionally occur during transit due to shipper handling. These minor issues are normal, expected, and temporary, as the plant will quickly recover and grow normally. Such minor damage is not considered a defect in the product. Please note:

  • A few branches or twigs may break. It's okay; they will grow back, and the plant will grow more branches from the break(s) and be fuller as a result.
  • Some leaves may turn yellow and fall off. It's okay; new leaves will sprout soon.
  • A few spots may appear on the leaves. It's okay. Plants are treated regularly and immediately before shipping to protect against pests and disease; light and fresh air will typically resolve the problem, and new leaves will grow.

Claiming for Severe Damage

In the unlikely event your plant sustains damage severe enough to affect its overall health and viability, please notify us immediately. We are committed to providing a high level of customer service and resolving problems quickly and courteously.

To file a claim, you must provide:

  • At least one photo dated within 24 hours of delivery showing:
    • The box with the address label visible.
    • A full view of the complete plant(s).
    • A brief explanation of the problem.

Carriers require this validation for any necessary claims on our end. Please submit your claim, including the required photos and explanation, directly to our Warranty Service Department at service@emeraldgoddessgardens.com.


Conditions for Warranty Voidance

This Warranty is voided by:

  • Failure to notify us within 24 hours of arrival.
  • Failure to provide required photo validation.
  • Proceeding with planting before contacting us regarding damage.
  • Failing to promptly pick up your package from parcel lockers, post office boxes, or other drop points, or refusing package delivery. 

Post-Delivery Plant Survival & Suitability

Because plants are perishable, living things, and there are many factors that determine whether live plants ultimately grow and thrive in their new environments that are out of our control, we are not able to guarantee the survival or growth of plants after they are delivered and planted, or their fitness or suitability for any particular purpose or environment. Therefore, no other, additional, extended, or long-term warranty is offered, express or implied.


Species & Cultivar Guarantee

We guarantee plants to be the species and cultivar as described in the listing, within recognized industry standards. While we are meticulous with tagging and handling, should you notice something that causes concern, please send us a picture and a brief description of the issue.


Limitation of Remedy & Liability

The remedy under this Warranty is strictly limited to a one-time product replacement or refund of the purchase price, at our discretion. Our liability under this Warranty is strictly limited to the purchase price of the plant(s). Under no circumstances shall we be liable for damages in excess of the purchase price or any special, incidental, indirect, or consequential damages. Only purchased plants are covered by this Warranty. Gift plants are excluded.


Returns

Return shipping of perishable, live plants is generally not feasible or allowed under the policies of our State Department of Agriculture, except under very restrictive guidelines.

In the event of severe, verified transit damage, as outlined in the Limited Warranty above, a return is generally not required. However, at our discretion, we may sometimes request plants be returned for quality control purposes. Refunds cannot be provided for unauthorized returns. Returns cannot be provided for plants returned due to delivery issues such as an insufficient address, inability to deliver (e.g., no parcel box), or if the package is 'refused'.


Important Safety Information: A Note on Toxicity

We often include basic toxicity information in plant listings when such information is available from reliable academic sources. However, this information is intended as general background only. Plant toxicology is complex. It is possible for some parts of all plants to cause adverse reactions under certain conditions and in some individuals. Therefore, the safest practice is to keep all plants out of the reach of pets, children, and other at-risk individuals, and to not allow unsupervised access to areas where plants are located. Always consult qualified professionals for detailed plant-specific information. The National Poison Control Center is staffed 24/7 at 1-800-222-1222.


Acceptance of Warranty Terms:

By placing an order and accepting delivery of the plants, you acknowledge and accept the terms of this Limited Conditional Warranty.
